FILING OF APPLICATIONS AND OBTAINING OF PATENTS IN AZERBAIJAN
1. Invention
1.1. Term of the Patent for an invention in the Azerbaijan - 20 years from date of application's filing in Azerbaijan PTO or from date of filing of international application with designation of the Azerbaijan. At filing of application can be established the convention priority in accordance with Paris convention.
The patent for the invention can be obtained for: device; method; substance; strain of microorganism; cultivation of cells of plants and animals; appliance of earlier known device, method, substance, strain for new purpose.
In the Azerbaijan are not recognized as an invention: scientific theories; mathematical methods; design; methods of control of property and intellectual activity; rules of games; computer algorithms and programs; methods of information's presentation; conventional symbols; schedules and rules; architectural projects and schemes; sorts of plants and animal's nature (except for microbiological methods and production, derivable by these methods); topology of integrated microcircuits; surgery and therapeutical methods of curing and diagnosing of human and animal diseases. These works are protected by the copyright and the law on selection of animals and plants and we can assist you in registration of these works and obtaining of patents on selection achievements.
1.2. Payment of annuities for issued Patent begins since 3-rd year. In case, if the next term of payment was skipped, that it can be restored only during 12 months.
1.3. Normal time from filing of application to obtaining of the patent - 20-30 months. At use of accelerated publication by request of applicant, term will reduce up to 10-12 months. We will provide you a possibility to receive the patent in a very short term.
1.4. Application for an invention can be reorganized in application for useful model (if it concerns the device).
1.5. The application is executed and filed in PTO of Azerbaijan in Azerbaijan language. The application also can be filed in other language with the enclosed translation into Azerbaijan language.
For filing of application for the invention are required:
- information about authors of the invention (surname, name and patronymic of the inventors, address);
- information about applicant (name of a legal person or name of a physical person);
- description and claim of the invention, drafts (if it is necessary) and abstract;
- Power of Attorney (legalization is not required).
If it is necessary to establish the convention priority - additionally it is required to present the certified copy of primary application, by which the convention priority is established.
If entering of international application into a national phase is reailized - additionally it is required to present a certified copy of PCT application or its official publication. At existence of the report about international search and/or examination of PCT application - it is necessary to present a copy.
The documents can be presented in any language, but for unusual languages it is desirable to have a translation into Russian and/or English language.
2. Useful Model
2.1. Term of Patent's validity for an useful model in the Azerbaijan - 10 years from date of application's filing in PTO of Azerbaijan.
The Patent for an useful model can be obtained only for device (devices, mechanisms, instruments or its part), and also for use of known device for a new purpose.
2.2. Payment of annuities for issued Patent begins since 3-rd year. In case, if next term of payment was skipped, that it can be restored only during 12 months.
2.3. Normal time from filing of application to reception of the patent - 20-30 months. At use of accelerated publication by request of applicant, term will reduce up to 10-12 months. We will provide you a possibility to obtain the patent in a shortest term.
2.4. An application for the useful model can be reorganized in application for invention.

3. Industrial Design
3.1. Term of Patent's validity for an industrial design in the Azerbaijan - 10 years from date of filing in PTO of Azerbaijan.
The industrial design can be as picture and/or model, determining appearance of a product.
Are not recognized as an industrial design the following objects:
- solutions, stipulated exclusively by technical function of a product;
- objects of architecture (except for small architecture forms);
- industrial stationary buildings;
- print production;
- objects of changeable forms of liquid, gasiform, quick or similar them substances.
3.2. Payment of the annuities for issued Patent begins since 3-rd year. In case, if next term of payment was skipped, that it can be restored only during 12 months.
3.3. Normal time from application's filing to receiving of the patent - 20-30 months. At use of accelerated publication by request of applicant, the term will be reduced up to 10-12 months. We will provide you a possibility to receive the patent in a very short term.
3.4. An application is executed and filed in PTO of Azerbaijan in Azerbaijan language. The application also can be filed in other language with the enclosed translation into Azerbaijan language.
For filing of an industrial design are required:
- information about authors (surname, name and patronymic, address);
- information about applicant (name of legal person or name of physical person, address);
- description of the industrial design and its photos (and/or drafts);
- Power of Attorney (legalization is not required).
The photos must be, as a rule, black-and-white and in the following kind:
- general view (10 copies);
- back view (5 copies);
- view from the left (5 copies);
- view from the right (5 copies);
By necessity must be presented view from top (5 copies) and view from bottom (5 copies). Also can be presented the drafts and/or model of the declared industrial design.
If the color is one of the important features of an industrial design, additionally must be enclosed a color photography of general view of a product (5 copies). The photos must be in size 18x24 centimeters (for small products is allowed 13x18 centimeters or 9x12 centimeters).
The documents can be presented in any language, but for unusual languages it is desirable to have a translation into Russian or English language.
