REQUIREMENTS FOR A TRADEMARK REGISTRATION
1. For registration of a trademark it is necessary to present:
- A sample of a trademark(mark of services) or geographical designation.
If it is a black-and-white verbal mark, it will be enough to specify its correct writing in a your order.
If it is a color, pictorial or combined mark - it is necessary to send 15 samples.
- To specify title(name) of an applicant and address.
- To sign the Power of Attorney (legalization is not required).
2. Terms of consideration and registration of a trademark:
- Usually from date of application's filing before obtaining of the Certificate on trademark it is required 8-9 months.
- At payment of the additional duty (70$) for acceleration of examination in essence the term is reduced to 5-6 months.
- In case if you provide us wih full set of documents (including the Power of Attorney) and specify the payment of the duties for filing of application and accelerated examination simultaneously with filing of application - all procedure will take 1,5-2 months.
3. Term of validity of a registered trademark - 10 years from date of application's filing. If necessary, this term can be renewed each time to 10 years.
4. The application is filed into Patent Office of Azerbaijan in Azerbaijan language. Directing an order it is desirable to present the description of the declared goods and services in English and/or Russian language.
RENEWAL OF A REGISTERED TRADEMARK
Duration of the registered trademark - 10 years from date of application's filing. If necessary, this term can be prolonged each time to 10 years.
Renewal of the next validity must be carried out during 6 months before the current validity term of trademark ends. If this term is missed, it may be restored only during 6 months from date of ending of the previuos term of validity. After that renewal will be impossible. But it always possible to file a new application for the same trademark.
For renewal of a registered trademark it is necessary to send:
- The Power af Attorney;
- The Certificate (original) to add the data regarding prolongation of the validity term.
If the original is lost or by any reason cannot be sent, that it is possible:
- either to obtain the duplicate of the Certificate, where will be entered the instruction on renewal of this mark;
- or to obtaine the simple notification on renewal.
